benharveyfit ai — Terms of Use

These Terms of Use ("Terms") govern your use of the benharveyfit ai app and the website at benharveyfit.com (together, "the Service"), operated by Ben Harvey ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

What the Service is

benharveyfit ai provides fitness coaching and tracking based on the Ben Harvey Protocol — a chat-first AI coach that logs your meals, workouts, weight, and sleep and holds you accountable. Coaching and estimates are AI-generated, for motivation and general fitness guidance only.

Not medical advice

The Service provides general fitness and motivation content. It is not medical, nutritional, or professional advice, and is not a substitute for it. Consult a qualified professional before making changes to your diet, exercise, or health routine. You use the Service at your own risk.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. The Service is not directed to children under 13.

Your content

You keep ownership of the photos, videos, and other content you submit. You grant us a limited license to process that content solely to provide the Service to you (for example, sending a meal photo to our AI provider to estimate its protein), as described in our Privacy Policy. You are responsible for the content you submit and confirm you have the right to submit it.

Acceptable use

Don't misuse the Service: no uploading content you don't have rights to, no attempting to break, overload, reverse-engineer, or abuse the Service, and no using it for unlawful purposes.

Pricing & subscriptions

• benharveyfit ai is currently free to use — the AI coaching, logging, and the full program are available at no cost, with no card required. If we introduce a paid feature in the future, any charge is always shown and confirmed before you pay.
• An optional auto-renewing subscription ("Pro") may be offered through the Apple App Store — for example, to remove the daily coaching cap. Pricing and billing period are shown in the app before you confirm any purchase; you are never charged without confirming.
• If you choose to subscribe, payment is charged to your Apple ID at confirmation of purchase, and the subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
• You manage or cancel your subscription in Settings → [your name] → Subscriptions on your iPhone, or at apps.apple.com/account/subscriptions.
• Refunds are handled by Apple under the Apple Media Services Terms.
• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

Cancellation & account deletion

You can stop using the Service at any time. You can permanently delete your account and all associated data in Settings → Delete account inside the app. See the Privacy Policy for what deletion removes.

Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on any score, plan, or coaching content.

Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use after changes means you accept the updated Terms.
